Regarding the Hate Speech Statute on Social Media, Musk’s X is Suing the State of New York

A New York state legislation requiring social media businesses to reveal how they regulate hate speech, extremism, and other controversial information has been challenged by Elon Musk’s X. The social media site, formerly known as Twitter, filed a complaint on Tuesday, claiming that the legislation requires businesses to reveal “highly sensitive and controversial speech” that is protected by the First Amendment of the constitution.

The stated defendant in X’s complaint is New York Attorney General Letitia James, who is responsible for implementing this statute. According to a recent study by the Reuters Institute, social media platforms have emerged as the primary news source for Americans, with the majority of them consuming it on networks like X.

Determining what content is appropriate for social media “engenders considerable debate among reasonable people about where to draw the correct proverbial line,” according to X. “This is not a role that the government may play. The Stop Hiding Hate Act, which was approved in December, requires social media firms to report their progress and reveal the measures they use to eradicate hatred on their platforms.

Social media firms like X were referred to as “cesspools of hate speech” by the two New York state senators who sponsored the Stop Hiding Hate Act in a statement released on Tuesday, but they insisted that the measure did not infringe upon the First Amendment.
