According to the attorneys for Texas, whose team included the plaintiffs firm Keller Postman, the terms of the settlement, which were made public on Tuesday, represent the largest agreement ever reached by a single state.
Law firms following the litigation claim that the 2022 lawsuit was the first significant case brought under Texas’ 2009 biometric privacy law. A legal clause stipulates that each infraction may result in damages of up to $25,000.
Texas accused Facebook of “billions of times” collecting biometric data from images and videos uploaded by users as part of a free, now-canceled feature known as “Tag Suggestions” on the social media site.
The company is happy to have the issue resolved, according to a Meta representative, and it is looking forward to “exploring future opportunities to deepen our business investments in Texas, including potentially developing data centres.
It has persisted in rejecting any misconduct.
The settlement represents the state’s “commitment to standing up to the world’s biggest technology companies and holding them accountable for breaking the law and violating Texans’ privacy rights,” according to a statement from Texas Attorney General Ken Paxton.
